CURRENT PROBLEMS OF CRIMINAL PROCEDURAL LEGISLATION OF UKRAINE DURING THE PERIOD OF MARTIAL STATE

Abstract

The article aims to study the regulatory legal acts that were adopted and put into effect during martial law, namely in the period from 2022 to 2025 inclusive. The need to analyze these regulatory legal documents was associated with determining their significance and the generation of certain risks and problems during law enforcement activities. The study is based on a comprehensive analysis of regulatory legal acts (CPC of Ukraine, legislative initiatives 2022–2025), decisions of the Constitutional Court of Ukraine, official reports of international institutions (Council of Europe, UN, Human Rights Watch, Amnesty International), analytical materials of Ukrainian departments and public organizations, as well as a review of scientific and industry literature. The methods used comprehensively in the research process allowed us to obtain substantiated results. The specified methods included: formal and legal analysis, comparative method, content analysis of official reports and expert interpretation, as well as the method of analysis and synthesis, and prognostic method. Results and conclusions of such activities. The article provides a comprehensive analysis of the problems of the criminal procedural legislation of Ukraine as of 2024–2025. The issues of judicial control over detention under martial law, the independence of anti-corruption bodies, the digitalization of the process and the status of electronic evidence, the conditions of detention and the harmonization of national legislation with the Rome Statute of the ICC are considered. Specific legislative and institutional measures are proposed to harmonize procedures and strengthen human rights guarantees in criminal proceedings.
