CROSS-BORDER CRIME: CONCEPTS, SIGNS AND ROLE IN THE GLOBALIZATION OF TRANSNATIONAL CRIME

Abstract

The article aims to study the concepts, signs and role of cross-border crime in the globalization of transnational crime. To achieve this goal and obtain objective results, a complex of methods of scientific research was applied, namely: formal-logical method, system-structural method, comparative legal method, method of analysis and synthesis, prognostic method. Results and conclusions of such activity. The article substantiates that cross-border crime is a complex socio-legal phenomenon, which combines the features of organized criminal activity and at the same time acts as a basic platform for the formation of transnational criminal networks. Cross-border crime is characterized by a high level of mobility, conspiracy, the ability to integrate into legal economic structures and to actively use modern technologies, which complicates its identification and counteraction. The presence of a clear organizational structure, stable channels of interaction and the use of corruption mechanisms enhance its stability and influence on national and international security. It has been proven that the spread of cross-border crime is due to a number of socio-economic, political and legal factors, including globalization, technological development, armed conflicts, weakness of international mechanisms of counteraction and shadowing of the economy.Cross-border crime creates the basis for the globalization of transnational criminal practices, integrating local schemes into interstate criminal networks, which leads to increased interdependence of criminal groups in the world and forms serious challenges for states and international institutions. Effective counteraction to this phenomenon requires the improvement of national legislation, strengthening the institutional capacity of law enforcement agencies, active interstate coordination and the use of global mechanisms of security in the field of security.
