REALIZATION OF HUMAN RIGHTS AND THEIR PROTECTION IN THE ERA OF TRANSFORMATIONAL PROCESSES IN UKRAINE

Abstract

The purpose of the article is to highlight the basic constitutional rights of a person in the current state and how Russia’s military aggression affected the possibility of realizing basic human rights and freedoms. A person, his rights and freedoms constitute the highest social value in a legal state, precisely for their provision and fullest realization in all transformational processes. In particular, the realization of rights in social life as the main human-centered ideology should be directed to all state activity. Even in the conditions of war, it is impossible to forget or neglect the main aspects and principles of the constitutional system of Ukraine, which is based on the recognition of a person, his life and health, his honor and dignity, inviolability and security as the highest social value, the priority of his rights and freedoms. The results. Today, more than ever, we are clearly aware of the value of human rights and freedoms. Our soldiers defend and protect the fundamental rights guaranteed to us by the Constitution of Ukraine and a number of other legal acts around the clock. Being close to the aggressor, there is an awareness of the value of the fundamental rights that we are endowed with in Ukraine and the awareness of the need to enjoy basic rights and freedoms, being a free person on a free land. From February 22, 2022, many legal experts are discussing the illegality of introducing certain restrictions on our constitutional rights within the framework of ensuring the defense and protection of the state. We can continue to discuss these issues in our research, but we must understand the ultimate goal of the respective limitations. After all, not only our principles and ambitions are at stake, but the life of the entire nation and the state of Ukraine. During the writing of this article, methods of generalization and analysis and deduction were used. Conclusions. Regardless of modern challenges or an external aggressor, any intervention of the state authorities in the implementation and provision of our rights must be clearly legally established, comply with the provisions of the Constitution and be justified. In cases of illegal restrictions on the rights of a person and a citizen, the law provides for their protection through court proceedings. In addition to judicial protection of violated rights, the state guarantees the restoration of violated rights in the event of an appeal to the Commissioner of Human Rights of the Verkhovna Rada of Ukraine. We can turn to a number of other bodies, such as the Constitutional Court of Ukraine and the European Court of Human Rights, where everyone is guaranteed the right to appeal on the grounds established and defined by the legislation of Ukraine.
