REFORM OF THE MECHANISM OF THE UN SECURITY COUNCIL THROUGH THE PRISM OF THE WAR BETWEEN THE RUSSIAN FEDERATION AND UKRAINE
Abstract
The purpose of the article is to analyze the activities of one of the main bodies of the United Nations – the Security Council, which according to Article 24 of the UN Charter is responsible for maintaining international peace and security in the context of the war between Ukraine and the Russian Federation. The issue of the effectiveness of the activities of the UN Security Council has always aroused the interest of scientists and specialists in international law, and with the beginning of the aggression of the Russian Federation against Ukraine, this question for scientists from Ukraine and other European countries acquired, in addition to the theoretical, a very practical dimension. Prospects for reforming the mechanism for ensuring peace and security, in particular, through the activities of the UN Security Council, are also considered in the article, taking into account possible scenarios of the development of events. The results of the study of the selected topic showed significant flaws in the existing mechanism for implementing the powers of the UN Security Council in the event that the interested party in solving the issue, or even worse, the aggressor, is one of the countries that are permanent members of the Council. The reasons for this situation and the possibilities of reforming this body to ensure its further effectiveness are analyzed. The conclusions of the conducted analysis lead to an understanding of the reasons for the situation of inefficiency in the implementation of the mechanism for resolving international conflicts in the UN Security Council in the event that one of the permanent members of the Council is a party to the conflict. The reasons for obtaining the status of a permanent member of the UN Security Council by the Russian Federation are analyzed and the dubiousness of such a status is substantiated in the conditions of such a country’s violation of the fundamental principles of international law.
