THE OFFICIAL AS A SUBJECT OF THE OFFICIAL NEGLIGENCE

Abstract

This article is dedicatedto the concept of the official as a subject of a crime under the Article 367 of the Criminal Code. The author concideres the characteristics of the official and its types in the context of the analysis of the current legislation.It is proposed by clarification in p. 3 of the Article 18 of the Criminal Code to recognize an individual entrepreneur as an officialin cases when they are employers.
