DISPOSITIVE COMPONENT OF EDUCATION QUALITY ASSURANCE SYSTEM UNDER THE LAW OF UKRAINE

The article identifies the area of dispositive administrative regulation of maintenance of quality of the education under the legislation of Ukraine. It was revealed that the legal basis of the domestic mechanisms designed for ensuring the quality of education includes a significant number of dispositive legal rules, the vast majority of which serves as a ground of the voluntary nature of some of the afore-mentioned mechanisms and encourages educational institutions to use with a view to bringing from them substantial financial, organizational and reputational benefits. In addition, having researched the provisions of the educational legislation concerning the foundation and activities of non-governmental institution for the quality of education assessment, it is inferred that an excessive disposition in certain provisions on the functioning of measures of quality maintenance in education reduces their effectiveness, which can be remedied by the establishment of mandatory rules in appropriate cases or by a combination of means of imperative and dispositive regulation.
