TOOLS FOR IMPLEMENTING LOCAL SELF-GOVERNMENT UNDER MARTIAL LAW

Abstract

The purpose of this article is to study the tools of local self-government in Ukraine during the legal regime of martial law. To achieve the set goal and obtain the appropriate results, the following set of methods was used: logical method, system analysis method, forecasting and modeling method, comparative method, formal-legal method. The results of such activity: the information on the normatively defined tools for the implementation of local self-government in the conditions of war, information on the possibility and methods of their application are characterized; examples of the use of local self-government tools in order to ensure the implementation of local self-government during the legal regime of martial law are identified, the range of problems that arise during the implementation of local self-government in Ukraine during the legal regime of martial law and methods of solving the corresponding problems are determined, ways of improving methods and tools are considered implementation of local self-government during the legal regime of martial law. Conclusions. The author made a conclusion about the importance of proper application of the tools of local self-government in the conditions of martial law. It was determined that the tools of local self-government have undergone certain changes due to the shift of greater attention to ensuring the country’s defense capability, strengthening of security measures on the ground, as a result of which military administrations were formed, the functioning of which is extremely important today. It is emphasized that proper use of the tools of local self-government in the conditions of the legal regime of martial law is possible only in the case of improvement of the relevant legislative framework, which regulates the issue of the use of tools for the implementation of local selfgovernment in Ukraine.
