GUARANTEES FOR IMPLEMENTING PROCESSING COMPETENCE BODIES OF THE PROSECUTOR ON THE BASIS OF THE INDEPENDENCE PRINCIPLE

Abstract

The article is devoted to the allocation of guarantees on the implementation of the procedural competence of the prosecutor’s office on the principles of independence. The content of the principle of independence as the basic basis for determining the procedural competence of the prosecutor’s offices is disclosed. The content of the principle of independence is disclosed through the elements of the immunity of the prosecutor’s office as a legal phenomenon. The external and internal levels of independence of the prosecutor’s office, corresponding to the levels of independence of the judiciary, and the guarantees of independence are allocated. Disciplinary proceedings in the activities of the prosecutor’s office were investigated from the standpoint of guaranteeing the functioning of the system of prosecutor’s office based on the principles of independence.
