THE FEATURES OF THE SALE OF NARCOTICS, PSYCHOTROPIC SUBSTANCES OR THEIR ANALOGUES COMMITTED BY ORGANIZED GROUPS

Abstract

The article deals with the features of sale of narcotic drugs, psychotropic substances or their analogues, which is carried out by organized groups. It was found out that guilty persons sell these substances to both acquaintances and strangers, depending on the peculiarities of their activities. The trend of distribution of drug sales using the Internet is revealed. Since such actions are characterized by increased social danger, it is proposed to fix sale of narcotic drugs, psychotropic substances or their analogues made by using the electronic networks in the part 3 of the Art. 307 of the Criminal Code of Ukraine as a circumstance that aggravates criminal liability for the commission of this crime. In connection with increased social danger of the production and sale of drugs, psychotropic drugs and their analogues in comparison with other acts enshrined in the part 1 of the Art. 307 of the Criminal Code, it is proposed to transfer them to circumstances that aggravate the liability for this crime (to the part 2 of the Art. 307 of the Criminal Code).
