TOPICAL ISSUES OF ENSURING THAT THE INVESTIGATING JUDGE INVESTIGATES COMPLAINTS DURING A PRE-TRIAL INVESTIGATION WITH THE PARTICIPATION OF DETAINED PERSONS OR DETAINED PERSONS

Abstract

The issue of ensuring the participation of detained persons or persons held in custody during a consideration by an investigating judge of their complaint about the decision, action or omission of the investigator, the prosecutor, in the court session is considered in this article. It is noted that the mandatory ensuring detained persons or persons held in custody in the court session on the day of the consideration complaint is in some cases impossible due to the short deadlines for handling complaints and the difficulty of delivering such persons to court. It is indicated that for resolve this problem, for order to adhere to the principles of competition and ensure the participation of these persons in the court session, it is expedient to use the means of remote pretrial investigation – the video conference. The processualoder for ensuring use of videoconferencing during the court session is considered. Video conference is applied on the basis of the relevant of the investigating judge decision, which is taken during the preparatory stage of the consideration of the complaint in court.
